A BILL
To amend title XVIII of the Social Security Act to permit certain
skilled nursing facilities to participate in the 3-year transition period under
the prospective payment system for skilled nursing facility services.
Be it enacted by the Senate and House of Representatives of the United
States of America in Congress assembled,
SECTION. 1. APPLICATION OF PPS TRANSITION PERIOD TO CERTAIN SKILLED NURSING
FACILITIES.
(a) IN GENERAL- Section 1888(e)(2)(E) of the Social Security Act (42
U.S.C. 1395yy(e)(2)(E)) is amended--
(1) in clause (ii), by striking `In' and inserting `Subject to clause
(iii), in'; and
(2) by adding at the end the following:
`(iii) SPECIAL RULE- Clause (ii) shall not apply (and the transition
period shall apply) to a skilled nursing facility that--
`(I) received a medicare provider number prior to August 30,
1995;
`(II) provided services to beneficiaries under this title prior to
such date; and
`(III) elects to waive the application of clause
(ii).'.
(b) EFFECTIVE DATE- The amendments made by subsection (a) shall take
effect as if included in the enactment of the Balanced Budget Act of 1997
(Public Law 105-33; 111 Stat. 251).
