FORT WORTH - A state judge has ruled that a lawsuit by two nurses over the safety of syringes will be tried as a class action. The lawsuit filed in April 1998 alleges that conventional syringes are hazardous products. It seeks compensation for health-care workers for the expenses of testing and counseling after they were accidentally struck by used needles.

State District Judge Bob McGrath's order classifying the suit as a class action came Thursday, the same day a similar suit in New York was dismissed. Plaintiffs in the Tarrant County case are nurses Sue Wang of Houston and Joan Usrey of Fort Worth.

McGrath did not decide whether the suit's claims have merit.
