Title XIV—General Provisions
Part A—Definitions
This part defines terms
used in the act.
Part B—Flexibility in the Use of Administrative
and Other Funds
This section allows
states and school districts to consolidate their administrative
funds from Title I, bilingual education, professional development,
and other ESEA programs, along with administrative funds allowed
under Goals 2000.
Part C—Coordination of Programs; Consolidated
State and Local Plans and Applications
States and school
districts may apply for federal ESEA funds in a consolidated
application if they receive prior approval from the secretary of
education.
Part D—Waivers
States and school
districts may receive waivers from certain statutory and regulatory
requirements if they can demonstrate that the waivers will improve
instruction and student performance.
Part E—Uniform Provisions
This section outlines
administrative requirements for states and schools participating in
ESEA programs. These provisions govern such issues as
- participation of
private school children in ESEA programs
- denial of federal
ESEA funds to school districts that willingly ignore a court order
allowing constitutionally protected prayer in
schools
- the use of ESEA
funds to "develop or distribute materials, or operate programs or
courses of instruction directed at youth that are designed to
promote or encourage sexual activity, whether homosexual or
heterosexual"; "distribute or aid in the distribution by any
organization of legally obscene materials to minors on school
grounds"; "provide sex education or HIV prevention education in
schools unless such instruction is age-appropriate and includes
the health benefits of abstinence"; or "operate a program of
condom distribution in schools"
- prohibition of
federal direction or control of a state, local, or school
curriculum or program of instruction, and prohibition of mandatory
allocation of funds by states and local entities for costs
incurred that are not paid for by this act
- prohibition of
federal funding for religious worship or instruction
Part F—Gun Possession
This section requires
states to enact laws requiring schools to expel for one year
children who bring guns to school.
Part G—Evaluations
Part G provides for
evaluations of programs included in ESEA and ESEA programs
coordinated with programs under other
laws. |
