A BILL
To amend the Individuals with Disabilities Education Act to allow
State educational agencies and local educational agencies to establish and
implement uniform policies with respect to discipline and order applicable to
all children within their jurisdiction to ensure safety and an appropriate
educational atmosphere in their schools.
Be it enacted by the Senate and House of Representatives of the United
States of America in Congress assembled,
SECTION 1. SHORT TITLE.
This Act may be cited as the `Freedom to Learn Act'.
SEC. 2. UNIFORM DISCIPLINARY POLICIES UNDER THE INDIVIDUALS WITH
DISABILITIES EDUCATION ACT.
Section 615(k) of the Individuals with Disabilities Education Act (20
U.S.C. 1415(k)) is amended--
(1) by redesignating paragraph (10) as paragraph (11); and
(2) by inserting after paragraph (9) the following:
`(10) UNIFORM DISCIPLINARY POLICIES- Notwithstanding any other provision
of this Act, each State educational agency or local educational agency may
establish and implement uniform policies with respect to discipline and
order applicable to all children within its jurisdiction to ensure safety
and an appropriate educational atmosphere in its schools.'.
