A BILL
To amend title XIX of the Social Security Act to require States
Medicaid plans to provide for payment for costs of medical services under
individualized education programs under the Individuals with Disabilities
Education Act after they exceed $3,500 in a school year.
Be it enacted by the Senate and House of Representatives of the United
States of America in Congress assembled,
SECTION 1. SHORT TITLE.
This Act may be cited as the `Smart IDEA Act of 1999'.
SEC. 2. MEDICAID COVERAGE OF COSTS OF MEDICAL SERVICES UNDER INDIVIDUALIZED
EDUCATION PROGRAMS UNDER THE INDIVIDUALS WITH DISABILITIES EDUCATION ACT BEYOND
$3,500 IN A SCHOOL YEAR.
(a) IN GENERAL- Title XIX of the Social Security Act is amended--
(1) by redesignating section 1935 as section 1936, and
(2) by inserting after section 1934 the following new section:
`COVERAGE OF COSTS OF MEDICAL SERVICES UNDER INDIVIDUALIZED EDUCATION
PROGRAMS UNDER THE INDIVIDUALS WITH DISABILITIES EDUCATION ACT AFTER THEY EXCEED
$3,500 IN A SCHOOL YEAR
`SEC. 1935. (a) IN GENERAL- Notwithstanding any other provision of this
title--
`(1) each State plan under this title shall provide medical assistance
described in subsection (b); and
`(2) such medical assistance is not required to be provided to
individuals other than children described in such subsection.
`(b) CONFORMING DEFINITION OF MEDICAL ASSISTANCE- For purposes of this
title, the term `medical assistance' includes payment for all of the costs of
medical services furnished to any child pursuant to, and in accordance with,
an individualized education program (as defined in section 614(d)(1)(A) of the
Individuals with Disabilities Education Act (20 U.S.C. 1414(d)(1)(A)) for that
child, but only insofar as such costs exceed $3,500 in any school year.'.
(b) EFFECTIVE DATE- The amendments made by subsection (a) take effect on
the date of the enactment of this Act and apply to medical services furnished
on or after such date, without regard to whether or not final regulations to
carry out such amendments have been promulgated by such date.
