The regulation activity presented below is sorted by rulemaking project title within stage of development. The four stages of development in the regulatory process are as follows:

The Office of Administrative Law (OAL) is a state agency in California responsible for reviewing regulations adopted by other state agencies for compliance with specified statutory criteria. OAL generally must approve or disapprove a final regulatory action within 30 working days after an agency submits the regulations to OAL.

       
I. Regulation Proposals Under Formal Public Review (45-Day Notice Issued)    

Federal Exhaust Emission Standards for 2008 and Later Model-Year Heavy-Duty Gasoline Engines and the Adoption of Minor Amendments to the Lower-Emission Vehicle Regulations
(November 14, 2002)
Description: Public Hearing to Consider incorporation of federal exhaust emission standards for 2008 and later model-year heavy-duty gasoline engines and minor administrative amendments to the exhaust emission regulations for light-, medium-, and heavy-duty vehicles and engines. Proposed amendments to the Low-Emission Vehicle II (LEV II) regulations for light- and medium-duty vehicles include a requirement that fuel-fired heaters used in conventional vehicles meet the same standards as those used in zero-emission vehicles, modifications to the allowable maintenance schedule for test vehicles and some administrative amendments including modifications to the labeling specifications. The proposed amendments pertaining to heavy-duty diesel engines consist of a non-substantive reorganization and update to the certification requirements and test procedures.


Affected Regulations: Amendments to title 13, California Code of Regulations (CCR), section 1961, and the incorporated "California Exhaust Emission Standards and Test Procedures for 2001 and Subsequent Model Passenger Cars, Light-Duty Trucks, and Medium-Duty Vehicles" as last amended July 30, 2002; section 1965 and the incorporated "California Motor Vehicle Emission Control and Smog Index Label Specifications" as last amended November 22, 2000; section 1956.8 and the incorporated "California Exhaust Emission Standards and Test Procedures for 2004 and Subsequent Model Heavy-Duty Otto-Cycle Engines" as last amended December 27, 2000; sections 1956.1 and 1956.8 and the incorporated "California Exhaust Emission Standards and Test Procedures for 1985 and Subsequent Model Heavy-Duty Diesel Engines" as last amended December 8, 2000; and section 1978 and the incorporated "California Refueling Emission Standards and Test Procedures for 2001 and Subsequent Model Motor Vehicles." Adoption of the new "California Exhaust Emission Standards and Test Procedures for 2004 and Subsequent Model Heavy-Duty Diesel Engines," to be incorporated in section 1956.1 and 1956.8 and the new "California Smog Index Label Specifications for 2004 and Subsequent Model Passenger Cars and Light-Duty Trucks," to be incorporated in section 1965.

Amendments to Administrative Hearing Procedures "Administrative Penalty Program"
(December 12, 2002)
Description: Public Hearing to Consider Amendments to Administrative Hearing Procedures, " Administrative Penalty Program". The amendments modify the current Administrative Hearing Procedures for the review of Complaints and the Administrative Hearing Procedures for the Review of Citations. ARB staff is proposing modifications to these regulations to implement the relevant provisions f Senate Bill (SB) 527. SB 527 authorizes ARB to impose administrative penalities as an alternative to pursuing civil penalites through the courts ("Administrative Penalty Program").


Affected Regulations: Amendments to title 17, California Code of Regulations (CCR), section 60065.1 through 60065.45, and 60075.1 through 60075.45.

California Reformulated Gasoline Regulations Including Refinements to The Prohibitions of MTBE and other Oxygenates (December 12, 2002) Description: Public Hearing to to consider amendments to the California Reformulated Gasoline (CaRFG) Regulations. The proposed amendments would (1) revise the prohibitions of gasoline produced with the use of MTBE or other prohibited oxygenates; (2) revise the schedule for implementation of allowable residual MTBE levels in California gasoline; (3) establish allowable residual levels for total weight percent oxygen supplied by oxygenates other than MTBE and ethanol; (4) add provisions for documentation of the presence or absence of ethanol in CaRFG delivered to retail outlets, and make other changes.


Affected Regulations: Proposed amendments to sections 2261(b)(3), 2262.6, and 2273, and adoption of 2260(a)(26.5) and 2273.5 of Title 13, California Code of Regulations (CCR).

Aiborne Toxic Control Measure to Limit School Bus Idling and Idling at Schools
(December 12, 2002)
Description: Public Hearing to Consider adopting a regulation to reduce public exposure to diesel exhaust particulate matter (diesel PM) and other toxic air contaminants (TACs) by limiting unnecessary idling of specified vehicular sources. The regulation focuses on reducing school age children's exposure at and around schools and while riding school buses and other types of school transportation.
 
Affected Regulations: : Proposed adoption of Chapter 10 - Mobile Source Operational Controls, Article 1- Motor Vehicles, section 2480, title 13, California Code of Regulations (CCR).

Enhanced Vapor Recovery Technology Review. (December 12, 2002) Description: Public Hearing to Consider adoption of amendments to the regulations for certification and testing of vapor recovery systems installed at gasoline dispensing facilities (service stations and similar facilities).
 
Affected Regulations: Proposed amendments to sections 94010, 94011, 94163, 94164, and 94165, title 17, California Code of Regulations (CCR) and the documents incorporated by reference therein. Proposed adoption of new sections 94166 and 94167, title 17, CCR, and the documents incorporated by reference therein.

Public Transit Bus Fleet Rule and Emission Standards for New Urban Buses
(October 24, 2002)
Description: Public Hearing to Consider Amendments to the Public Transit Bus Fleet Rule and Emission Standards for New Urban Buses. The amendments modify the current transit bus fleet rule and provide additional emission test procedures for specific urban buses, but do not affect new engine emission standards.
 
Affected Regulations: Proposed amendments to sections 1956.1, 1956.2, 1956.4, 1956.8, and 2112, title 13, California Code of Regulations (CCR), and the incorporated document titled "California Interim Certification Procedures for 2004 and Subsequent Model Hybrid-Electric Vehicles, in the Urban Bus and Heavy-duty Vehicle Classes."

California Reformulated Gasoline Regulation to Postpone Imposition of the CaRFG3
(July 25, 2002)
Description: Public Hearing to Consider Amendments to the California Reformulated Gasoline Regulations to Postpone Imposition of the CaRFG3 Standards and the Prohibition of MTBE and Oxygenates other than Ethanol in California Gasoline From December 31, 2002 to December 31, 2003.
 
Affected Regulations: Proposed amendments to sections 2261, 2262, 2262.4, 2262.5, 2262.6, 2262.9, and 2266.5, 2269, 2271, 2272, and 2296 of Title 13, California Code of Regulations (CCR)

AAQS Particulate Matter and Sulfates (June 20, 2002) Description: Public Hearing to Consider Amendments to Regulations for the State Ambient Air Quality Standards for Suspended Particulate Matter (PM) and Sulfates.
 
Affected Regulations: Proposed amendments to title 17, California Code of Regulations (CCR), sections 70100 and 70200; and proposed adoption of new section 70100.1.

Status: The Hearing Notice was published May 3,2002, for a public hearing on June 20, 2002 at 9:00 a.m. at the Air Resources Board, Auditorium, 9530 Telstar Ave., El Monte, CA 91731. At the hearing the Board approved the proposed regulations with modifications. A Notice of Public Availability of Modified Text was made available for August 15, 2002 through August 30, 2002. A Second Notice of Public Availability of Modified Text was made available for October 10, 2002 through October 25, 2002.

Diesel Retrofit Verification (May 16, 2002) Description: Public hearing to consider the the adoption of the Diesel Emission Control Strategy Verification Procedure, Warranty and In-Use Compliance requirements for on-road, off-road, and stationary diesel-fueled vehicles and equipment.
 
Affected Regulations: Proposed adoption of new sections 2700-2710, chapter 14, title 13, California Code of Regulations ("CCR") and the procedures incorporated by reference therein.

Status: The Hearing Notice was published March 29, 2002, for a public hearing on May 16, 2002 at 9:00 a.m. at the Air Resources Board, Central Valley Auditorium, 2nd Floor, 1001 "I" Street, Sacramento, CA 95814.

California Alternative Fuels For Motor Vehicle Regulations CNG-LPG (Cancelled)
Description: Amendments to the California Alternative Fuels for Motor Vehicle regulations compressed natural gas and liquefied petroleum gas specifications within the alternative fuels regulations.
 
Affected Regulations: Proposed amendments to title 13, California Code of Regulations, article 3, sections 2290, 2291, 2292.5, and 2292.6.

Status: The Hearing Notice was published December 21, 2001, for a public hearing on February 21, 2002 at 9:00 a.m. at the Air Resources Board, Coastal Valley Hearing Room, 2nd Floor, 1001 "I" Street, Sacramento, CA 95814. A Notice of Postponement was posted on February 19, 2002, for May 16, 2002 at 9:00 at the Air Resources Board, Auditorium, 9530 Telstar Avenue, El Monte, CA 91731. The Hearing for consideration of amendments to the California Alternative Fuels for Motor Vehicle Regulations has been cancelled. A new notice will be published at least 45 days in advance of the public hearing.

OBD II Malfunction and Diagnostic System Requirements (April 25, 2002) Description: Public hearing to consider technical status and proposed revisions to malfunction and diagnostic systems requirements and associated enforcement provisions for 2004 and subsequent model year passenger cars, light-duty trucks, and medium-duty vehicles and engines. The Board will consider amendments to the OBD II regulation to account for newer emission control technologies and lower tailpipe standards, to increase the amount of standardized data available to repair technicians and Inspection and Maintenance (I/M) inspectors, to clarify the regulation where necessary, to adopt more specific enforcement provisions, and to improve the effectiveness of the regulation for future model year vehicles.
 
Affected Regulations: Proposed adoption of title 13, California Code of Regulations (CCR) section 1968.2 to supersede the general OBD II requirements as set forth in title 13, CCR section 1968.1 for 2004 and subsequent model year passenger cars, light-duty trucks, and medium-duty vehicles and engines; and proposed adoption of title 13, CCR section 1968.5 to supersede the general enforcement procedures as set forth in title 13, CCR sections 2100-2149, as they apply to OBD II-related enforcement, and section 1968.1(i) for 2004 and subsequent model year model year passenger cars, light-duty trucks, and medium-duty vehicles and engines. .

Voluntary Accelerated Vehicle Retirement Regulations (February 21, 2002) Description: Adoption of amendments to Air Resources Board Voluntary Accelerated Vehicle Retirement Regulations to minimize differences between ARB and BAR VAVR regulations and allow parts recycling and resale of non-emission-related and non-drive train parts.
 
Affected Regulations: Proposed amendments to title 13, California Code of Regulations, sections 2601, 2603, 2604, 2606, 2607, 2608, 2609, 2610, and proposed adoption of section 2611 and Appendices C and D.
