ACTION: Notice of data availability. -----------------------------------------------------------------------
SUMMARY: On June 25, 1998 (63 FR 34685), EPA proposed technology-based effluent limitations guidelines, pretreatment standards, and new source performance standards for the discharge of pollutants into waters of the United States and into publicly owned treatment works (POTWs) by existing and new facilities that perform transportation equipment cleaning operations. Transportation equipment cleaning (TEC) facilities are defined as facilities that generate wastewater from cleaning the interior of tank trucks, closed-top hopper trucks, rail tank cars, closed-top hopper rail cars, intermodal tank containers, inland tank barges, closed-top hopper barges, ocean/sea tankers, and other similar tanks (excluding drums and intermediate bulk containers) used to transport materials or cargos that come into direct contact with the tank or container interior. This notice presents a summary of data received in comments since the proposal and an assessment of the usefulness of the data in EPA's analyses; presents new data collected by EPA to support effluent limitations in the Barge/Chemical & Petroleum Subcategory; presents a change from the mass-based limits format of the proposal; presents a modified subcategorization approach; reviews technology options considered for regulation; and discusses other specific issues raised by commenters including: selection of pollutants proposed for regulation, the costs associated with the regulation, a low flow exclusion, and the applicability of the rule. EPA solicits public comment on any of the issues or information presented in this notice of data availability and in the administrative record supporting this notice
