Key Provisions of the "Human Cloning
Prohibition Act of 2002"
-Prohibits human
reproductive cloning by imposing significant
criminal and civil penalties
-Allows
nuclear transplantation to produce stem cells
(therapeutic cloning)
-Applies Federal
ethical regulations on human subject research to
nuclear transplantation research
The bill
defines human cloning as "implanting or attempting
to implant the product of nuclear transplantation
into a uterus or a functional equivalent of a
uterus." In addition to prohibiting human cloning
as defined, the bill prohibits the shipping,
receiving or importing of the products of nuclear
transplantation for the purposes of human cloning.
It imposes substantial civil and criminal
penalties in the form of fines of at least a
million dollars and up to 10 years in prison. The
bill also applies Federal ethical standards to
nuclear transplantation research, including
informed consent, institutional and board review,
and protection for safety and privacy. The
legislation does not expressly preempt state law.
