Cloning Legislation Being Considered by the 107th Congress


"Cloning Prohibition Act of 2001" (Greenwood [HR2172])

(A) to use or attempt to use human somatic cell nuclear transfer technology with the intent to initiate a pregnancy; ……

(2) DEFINITION- For purposes of this section, the term `human somatic cell nuclear transfer technology' means transferring the nucleus of a human somatic cell into an egg cell from which the nucleus has been removed or rendered inert……

(b) RULE OF CONSTRUCTION- This section may not be construed as applying to any of the following:

(1) The use of somatic cell nuclear transfer technology to clone molecules, DNA, cells, or tissues.

(2) The use of mitochondrial, cytoplasmic, or gene therapy.

(3) The use of in vitro fertilization, the administration of fertility-enhancing drugs, or the use of other medical procedures to assist a woman in becoming or remaining pregnant.

(4) The use of somatic cell nuclear transfer technology to clone or otherwise create animals other than humans.

(5) Any other activity (including biomedical, microbiological, or agricultural research or practices) not expressly prohibited in subsection (a).

(1) IN GENERAL- Each individual who intends to perform human somatic cell nuclear transfer technology shall, prior to first performing such technology, register with the Secretary his or her name and place of business (except that, in the case of an individual who performed such technology before the date of the enactment of the Cloning Prohibition Act of 2001, the individual shall so register not later than 60days after such date). The Secretary may by regulation require that the registration provide additional information regarding the identity and business locations of the individual, and information on the training and experience of the individual regarding the performance of such technology……

"Human Cloning Prohibition Act of 2001" (Brownback [S790] /Weldon [HR1644]) April 26, 2001

laboratory because--

(i) cloning would take place within the privacy of a doctor-patient relationship;

(ii) the transfer of embryos to begin a pregnancy is a simple procedure; and

(iii) any government effort to prevent the transfer of an existing embryo, or to prevent birth once transfer has occurred would raise substantial moral, legal, and practical issues; and

(B) so, in order to be effective, a ban on human cloning must stop the cloning process at the beginning;…..

In this chapter:

(1) HUMAN CLONING - The term `human cloning' means human asexual reproduction, accomplished by introducing the nuclear material of a human somatic cell into a fertilized or unfertilized oocyte whose nucleus has been removed or inactivated to produce a living organism (at any stage of development) with a human or predominantly human genetic constitution.

(2) SOMATIC CELL- The term `somatic cell' means a diploid cell (having a complete set of chromosomes) obtained or derived from a living or deceased human body at any stage of development.

(a) IN GENERAL- It shall be unlawful for any person or entity, public or private, in or affecting interstate commerce--

(1) to perform or attempt to perform human cloning ;

(2) to participate in an attempt to perform human cloning ; or

(3) to ship or receive the product of human cloning for any purpose…..

(d) SCIENTIFIC RESEARCH- Nothing in this section shall restrict areas of scientific research not specifically prohibited by this section, including research in the use of nuclear transfer or other cloning techniques to produce molecules, DNA, cells other than human embryos, tissues, organs, plants, or animals other than humans.'……

"Human Cloning Prohibition Act of 2001" (Ehlers [HR1608]) April 26, 2001

(a) IN GENERAL- Whoever, in or affecting interstate or foreign commerce, knowingly replaces the nucleus of an oocyte with the nucleus of a human somatic cell shall be fined under this title or imprisoned not more than 2 years, or both.

(b) EXCEPTION- Subsection (a) shall not apply if, prior to replacement of the nucleus of the oocyte, the nucleus of the human somatic cell has been modified so that the cell cannot develop to completion.

(c) DEFINITIONS- In this section--

(1) the term 'somatic cell' means any cell other than a sperm or oocyte; and

(2) the term 'oocyte' means an egg cell.'……

"Human Cloning Prohibition Act" (Campbell [S704]) April 5, 2001

In this Act:

(1) HUMAN CLONING PROCEDURE- The term `human cloning procedure' means--

(A) the use of somatic cell nuclear transfer or any other cloning technique for the purpose of initiating or attempting to initiate a human pregnancy;

(B) the implantation of a conceptus, blastocyst, or embryo created through somatic cell nuclear transfer into a mammalian uterus; or

(C) the creation of genetically identical siblings by dividing a conceptus, blastocyst, or embryo for the purpose of initiating or attempting to initiate a human pregnancy.

(2) EGG- The term 'egg' means a mature female germ cell of any species.

(3) OOCYTE- The term 'oocyte' means an immature female germ cell of any species.

(4) PERSON- The term 'person' includes any individual, partnership, firm, joint stock company, corporation, association, trust, estate, or other legal entity.

(5) SOMATIC CELL- The term 'somatic cell' means any diploid cell of the human organism, including a cell of a conceptus,

embryo, fetus, child, or adult, not existing as a haploid germ cell.

(6) SOMATIC CELL NUCLEAR TRANSFER- The term 'somatic cell nuclear transfer' means transferring the nucleus of a human somatic cell into an oocyte or egg from which the nucleus has been removed or rendered inert.

(a) IN GENERAL- It shall be unlawful for any person to engage in a human cloning procedure.

(b) FEDERAL FUNDS- No Federal funds may be obligated or expended to conduct or support any research the purpose of which is to engage in a human cloning procedure……

"Human Cloning Research Prohibition Act" (Stearns [HR1372]) April 3, 2001

(a) PROHIBITION- None of the funds made available in any Federal law may be obligated or expended to conduct or support any project of research that includes the use of human somatic cell nuclear transfer technology to produce an oocyte that is undergoing cell division toward development of a fetus.

(b) DEFINITIONS- For purposes of this section--

(1) the term 'human somatic cell nuclear transfer' means transferring the nucleus of a human somatic cell into an oocyte from which the nucleus has been removed or rendered inert; and

(2) the term 'somatic cell' means a cell of an embryo, fetus, child, or adult which is not and will not become a sperm or egg cell……

Nothing in this Act shall restrict other areas of scientific research not specifically prohibited by this Act, including important and promising work that involves--

(1) the use of somatic cell nuclear transfer or other cloning technologies to clone molecules, DNA, cells other than human embryo cells, or tissues; or

(2) the use of somatic cell nuclear transfer techniques to create animals other than humans……

"Ban on Human Cloning Act" (Kerns [HR1260]) March 28, 2001

(a) IN GENERAL- It shall be unlawful for a person to engage in a human cloning procedure with the intent of implanting the resulting cellular product into a uterus.

(b) CLONING PROCEDURE- A person shall be considered to have engaged in a human cloning procedure for purposes of subsection (a) if the person transfers the nucleus of a human somatic cell into an egg cell from which the nucleus has been removed…….
